New York adult adoption requires a petition and the appropriate supporting documents, not merely a certificate of adoption and birth-record application. Use your filing court's adult-adoption checklist because local requirements can differ.
A real court checklist
The New York County Surrogate's Court adoption page lists an adult-adoption petition, adoptee consent, applicable spouse documents, an adoption agreement, proposed order, supplemental and identifying affidavits, and adoption reporting documents. Its attorney-proof form applies when an attorney represents the parties. Check which items the court requires for your circumstances; do not treat a county checklist as identical statewide paperwork.
Determine the correct county
Domestic Relations Law section 115(2) addresses county venue for private-placement adoption, including the situation in which the adopting parent does not reside in New York. Residence and the proceeding determine venue; the lowest fee is not the test.
Consent and notice remain separate
Section 111 contains the consent rules and adult provisions. Section 115(10) permits notice as directed by the judge or surrogate in adult adoption. Do not assume an adult case can never require notice to a birth parent or another interested person.
Appearance and signing
Section 115 also addresses examination, acknowledgment and circumstances in which personal appearance may be dispensed with for good cause. Ask for the court's instructions before signing or assuming a hearing will be remote. Health-related accommodations should be requested through the appropriate court process.
