Stepparent adoption in New York is governed by New York Domestic Relations Law Article 7, and you file your petition in Family Court or Surrogate's Court in your county. New York has 62 counties, including the New York City boroughs, and the courts serve all of them.
Who can adopt and where to file. N.Y. Dom. Rel. Law § 110 covers who may adopt, and N.Y. Dom. Rel. Law § 112 covers the petition for adoption. Under N.Y. Dom. Rel. Law § 115(2), venue is tied to the county where the adoptive parents live. New York sets no specific residency duration before you can file. Whether you choose Family Court or Surrogate's Court, the clerk in your county can tell you about local filing procedures.
Consent. Consent is a central part of the process, and it works in a few ways:
- The child: Under N.Y. Dom. Rel. Law § 111, a child over 14 must consent, unless the judge dispenses with it.
- The other legal parent: Consent is not always required. Under N.Y. Dom. Rel. Law § 111, it can be dispensed with if that parent abandoned the child, failed to support the child when able, or otherwise forfeited parental rights.
- Abandonment: Under N.Y. Dom. Rel. Law § 111(2), a parent who fails to visit or communicate with the child for at least 6 months may have the consent requirement waived.
If the other parent is unknown, unreachable, or likely to object, the outcome depends on your specific facts. Talk to the court clerk or an attorney about that issue.
Home study. New York does not waive the home study for stepparent adoptions. See N.Y. Dom. Rel. Law § 112(7); § 116. Ask your court clerk how investigations are handled in your county.
Adopting an adult stepchild. Adult adoption is permitted in New York. The adoptee must consent if over 14, unless the judge or surrogate dispenses with it. The other biological parent's consent is not required when the adoptee is over 18. The adoptee and everyone whose consent is required generally appear for examination before the judge or surrogate, though the court may excuse the adoptee's appearance. Adult cases typically take about 2-4 weeks.
Timeline and cost. A stepparent adoption of a child typically takes 3-6 months. Court filing fees generally run $200-$500, and the total typically comes to under $1,000 when you prepare the papers yourself. Hiring an attorney commonly costs $3,000-$5,000+.
What adoption does. Under N.Y. Dom. Rel. Law § 117, the adopted child becomes your legal child for all purposes. That means:
- full inheritance rights from you
- transfer of all legal rights and obligations
- termination of the biological parent's rights and obligations
- a new birth certificate, available through the New York State Department of Health Vital Records
