The man on my child's birth certificate is not the biological father — how does this affect adoption in Rhode Island?

In Rhode Island, a birth certificate that names a man who is not the biological father means you should confirm who is treated as your child's legal father before you file, because that affects whose consent, or whose abandonment, your Family Court petition has to address. The answer depends on your family's facts, so the Family Court clerk in your county or an attorney should confirm it for your situation.

What Rhode Island law tells us. Stepparent adoptions are filed in Family Court under Rhode Island General Laws Title 15, Chapter 7. The law has an abandonment provision, R.I. Gen. Laws § 15-7-7, which uses a period of 6 months. If the man on the certificate has had no involvement with your child, that provision may matter. Whether it applies to him, and how the court treats a man who is on the certificate but not the biological father, is a question for the clerk or an attorney.

The biological father. Rhode Island law on a biological father who is not named on the certificate is not something we can responsibly summarize here. If you know who he is, or a paternity case was ever started, tell the clerk or an attorney. The same goes if you don't know who he is, or if anyone might contest the adoption. These situations depend on facts, and a lawyer can advise on yours.

Other requirements that stay the same:

  • Child's consent: A child who is 14 or older must consent to the adoption (R.I. Gen. Laws § 15-7-5(a)).
  • Residency: Rhode Island sets no minimum residency period for the petition (R.I. Gen. Laws § 15-7-4).
  • Home study: It is waived in stepparent adoptions (R.I. Gen. Laws § 15-7-11).
  • Timeline: Stepparent adoptions in Rhode Island typically take about 3-6 months.

Your records. If you are unsure what your child's birth certificate says or how it was recorded, the Rhode Island Department of Health Office of Vital Records is the agency that holds those records. Check what it shows before you start, so your paperwork matches.

Questions to ask the clerk:

  • Who must consent or receive notice in your case, given the name on the birth certificate?
  • Does the abandonment provision apply to the man listed?
  • Are there extra steps if the biological father is known or unknown?
  • What is the current filing fee in your county? We don't quote a fee because the clerk can confirm the exact amount.
