If the biological father agrees, Iowa's process is more straightforward: he signs consent forms, you file them with your adoption petition in the District Court in your county, and the court can finalize once Iowa's 180-day period from filing has passed. Here is how it typically works.
What you file. Iowa's stepparent adoption paperwork includes:
- A Petition for Adoption
- Consent forms from the biological father (a termination petition is the alternative when consent isn't available)
- The spouse's consent to the adoption, meaning your consent as the child's parent
- The court filing fee, typically $150-$250
The steps.
- Prepare the paperwork. Gather the information for the petition and have the father's consent forms ready for his signature. Ask the District Court clerk in your county about any signing formalities for the consent.
- File with the District Court. You file the petition, the consents and the fee in the county where you are filing.
- Wait out the 180 days. Iowa requires a 180-day period from filing to finalization. Overall, stepparent adoptions in Iowa typically take 3-6 months.
- Finalize. Once the requirements are met, the court can finalize the adoption.
Why consent helps. When the father agrees, you are not trying to locate him or serve him by sheriff, process server or publication. You also do not have to build a case around abandonment. Iowa sets no fixed number of months for abandonment, and it depends on the parent's overall conduct (Iowa Code § 600A.8). With a consenting father, that question usually doesn't come up.
Other Iowa points that may matter to you.
- Residency: Iowa has no minimum residency period (Iowa Code § 600.3).
- Home study: Iowa waives the home study in stepparent adoptions (Iowa Code § 600.8).
- Your child's consent: The consent age is 14 (Iowa Code § 600.7). If your child is that age or older, plan for that consent as well.
- New birth certificate: After finalization, the Iowa Department of Public Health Vital Records handles the birth certificate. The District Court clerk can tell you how to request it.
Cost. Court filing fees typically run $150-$250, and the total typical cost is under $1,000, compared with $3,000-$5,000+ for an attorney.
When to get more help. An agreeing father makes things simpler, but every family's situation is different. If he changes his mind, if there are questions about who else must consent, or if you can't locate him, talk to the District Court clerk in your county or an Iowa family law attorney about your specific facts.
