You adopt your stepchild in Iowa by filing a petition for adoption with the District Court in your county, getting the required consents (or a termination petition for the other parent), and completing the court process under Iowa Code Chapter 600 until the judge finalizes the adoption.
What you file. Iowa's stepparent adoption paperwork generally includes:
- A Petition for Adoption
- Consent forms, or a petition to terminate the other parent's rights
- Your spouse's consent to the adoption
- The court filing fee, typically $150-$250
Where you file. Iowa has 99 counties, and your case goes to the District Court in your county. Families in Des Moines, Cedar Rapids, Davenport, Sioux City, Iowa City and elsewhere follow the same basic process, but the clerk can tell you about local forms and procedures.
Residency. Iowa sets no minimum residency period under Iowa Code § 600.3, so you do not have to live in the state for a set number of months before filing.
Your stepchild's consent. Iowa's child consent age is 14 under Iowa Code § 600.7. If your stepchild is 14 or older, the child's consent is part of the process.
The other parent. Iowa treats termination of the other parent's rights as a separate step from the adoption itself. If the other parent agrees, they sign a consent. If they do not, a termination petition is needed. Where abandonment is the issue, Iowa sets no fixed number of months. It depends on the parent's overall conduct (Iowa Code § 600A.8). Because contested cases and unknown-parent situations turn on specific facts, talk to the District Court clerk or an attorney about your circumstances.
Notice to the other parent. Iowa allows personal service by a sheriff or process server. If the parent's location is unknown, service by publication is allowed after a diligent search.
Home study. Iowa waives the home study for stepparent adoptions under Iowa Code § 600.8, which removes a step that can slow things down in other situations.
Timeline. Stepparent adoptions in Iowa typically take 3-6 months. Iowa requires a 180-day period from filing to finalization, so plan for that waiting period. The clerk can confirm how it applies to your case.
Cost. Court filing fees run about $150-$250. A stepparent adoption in Iowa can typically be completed for under $1,000 when you file on your own, compared with $3,000-$5,000+ when hiring an attorney.
After finalization. Once the adoption is final, the Iowa Department of Public Health Vital Records is the agency to contact about your child's records. Ask the clerk what certified documents you will need to bring.
