Adoption in Iowa is governed by Iowa Code Chapter 600, and a stepparent adoption is filed in the District Court in the county where your family lives (Iowa has 99 counties). The main rules for stepparent families are below.
Where you file: Your petition goes to the District Court clerk in your county. The clerk can confirm local forms, procedures and any details that vary by county.
Residency: Iowa has no minimum residency period before you can file (Iowa Code § 600.3).
Consent from the child: The child consent age is 14 (Iowa Code § 600.7). If you are adopting an older child, the court will look for that child's consent.
The other legal parent: The other parent's rights must be dealt with before a stepparent can adopt. That happens in one of two ways:
- The other parent signs a consent form.
- Or the rights are ended through a termination petition, which is a separate step in Iowa.
Iowa has no fixed number of months that counts as abandonment. Under Iowa Code § 600A.8, the court looks at the parent's overall conduct. Because that depends on the facts of your situation, a contested case or a parent who has been absent is a good time to talk with the District Court clerk or an attorney.
Home study: A home study is waived in stepparent adoptions (Iowa Code § 600.8).
What you typically file:
- Petition for Adoption
- Consent forms or a termination petition
- Your spouse's consent to the adoption
- The court filing fee
Notifying the other parent: Iowa allows personal service by a sheriff or process server. If the parent's location is unknown, service by publication is allowed after a diligent search. Ask the clerk what the court expects as proof of that search.
Timeline: Iowa requires a 180-day period from filing to finalization. A stepparent adoption typically takes 3-6 months, and an adult adoption typically takes 4-8 weeks.
Cost: The court filing fee usually runs $150-$250. A stepparent adoption you handle yourself typically costs under $1,000 in total, compared with $3,000-$5,000+ when hiring an attorney.
Your new birth certificate: After the adoption is final, the Iowa Department of Public Health Vital Records is the agency that handles vital records, including an updated birth certificate. Ask the clerk how to request it.
What the law doesn't spell out here: Questions about who can be adopted, unusual family situations, or how a judge will treat a particular set of facts depend on your circumstances. Please confirm those points with the District Court clerk in your county or with an attorney.
