A PCS move does not stop a stepparent adoption in Rhode Island, and Rhode Island sets no minimum residency period for filing (R.I. Gen. Laws § 15-7-4). If you have just arrived on orders, there is no required waiting period before you can start. Your petition goes to the Family Court.
If you are PCSing to Rhode Island:
- Because there is no set residency period, you do not have to count months before you begin.
- How the Family Court treats military orders as proof of where you live is something the clerk in your county can confirm. Rhode Island has five counties, and the clerk can tell you which court location handles your filing.
If you are about to PCS away:
- Rhode Island's usual timeline for a stepparent adoption is 3-6 months. If your orders are coming, that window is worth planning around.
- Whether a case can continue after you leave the state, and whether the judge allows a remote appearance at the final hearing, depends on the court. Ask the Family Court clerk before you move. If your situation is complicated, an attorney can advise you on it.
Parts of the process that matter for a mobile family:
- Home study: Rhode Island waives the home study for stepparent adoption (R.I. Gen. Laws § 15-7-11), so there is no home visit to schedule around a move.
- Child's consent: A child who is 14 or older must consent to the adoption (R.I. Gen. Laws § 15-7-5(a)). If your child is close to that age, plan for the consent to be in place before any move.
- The other parent: If the other legal parent will not consent, or cannot be found, the case depends on the facts. The abandonment period is 6 months (R.I. Gen. Laws § 15-7-7). Ask the clerk or an attorney about your specific situation, because a contested case is not something a form can resolve.
- Birth certificate: After the decree, a new birth certificate is requested through the Rhode Island Department of Health Office of Vital Records. Ask the clerk how to arrange it if you are moving soon.
Questions for the Family Court clerk:
- What is the current filing fee?
- Will the court accept a remote appearance if you have already left Rhode Island?
- Do your military orders need to be attached to the petition?
- What happens to the schedule if your move date shifts?
Getting these answers early keeps a move from becoming a surprise.
