In Iowa, you are likely eligible for stepparent adoption if you are an adult married to the child's parent and the other parent's rights are resolved, either by their consent or by a court ending them. Here is how the main pieces work.
Residency: Iowa sets no minimum length of time you must have lived in the state (Iowa Code § 600.3). You file in the District Court in your county, and the clerk can tell you which county is the right one for your situation.
Your age and status: Iowa Code § 600.4 allows an unmarried adult, or a husband and wife together, to adopt. Your District Court clerk can confirm the exact age that counts as an adult and any details about adopting as a married stepparent.
The other parent: This is usually the most important eligibility question. Iowa's process calls for one of two things:
- Consent forms signed by the other parent, or
- A termination petition asking the court to end that parent's rights. In Iowa, termination is a separate step from the adoption itself.
If the other parent is not involved in the child's life, abandonment may come up under Iowa Code § 600A.8. Iowa has no fixed number of months for abandonment. It depends on the parent's overall conduct. Because that turns on your facts, talk to the District Court clerk or an attorney if this applies to you or the other parent objects.
Your spouse's consent: Because you are adopting your spouse's child, your spouse's written consent to the adoption is part of the filing.
Your child's consent: Iowa Code § 600.7 sets the age of 14 for a child's consent. If your child is 14 or older, plan for their consent as part of the paperwork.
Home study: Iowa waives the home study in stepparent adoptions (Iowa Code § 600.8), so you generally don't need to schedule a home visit.
Finding the other parent: Iowa allows personal service by a sheriff or process server. If the other parent's location is unknown, it allows service by publication after a diligent search. How hard you must search is a question for the clerk or an attorney.
