Do I need the biological father's consent for stepparent adoption in Alabama?

Usually, yes, you need to deal with the biological father's consent, but it doesn't have to be his signature. In Alabama, your petition must include either consent forms or grounds for implied consent. If he agrees, he signs a consent. If he won't or can't, the question becomes whether the facts support implied consent.

If he agrees. A signed consent from the biological father is the simplest route. Your filing also includes your spouse's consent to the adoption.

If he doesn't agree or isn't involved. Alabama's abandonment provision is built around a four-month period (Ala. Code § 26-10E-9(a)(1), (a)(4)). Whether his situation meets that standard depends on the specific facts: his contact with your child, his support, and how the court views it. The Probate Court clerk in your county or an attorney can tell you how that applies to you. If he contests the adoption, talk to an attorney about your case.

If you don't know where he is. Alabama allows personal service on the father, or service by publication if his location is unknown. Either way, he is formally notified of the adoption.

Other consents to know about:

  • Your spouse: The stepparent adoption petition includes your spouse's consent.
  • Your child: A child who is 14 or older has a consent role under Ala. Code § 26-10E-7(a)(1).

Where you file. Stepparent adoptions in Alabama are filed in the Probate Court, and there are 67 counties. Alabama has no minimum residency period before you can file. The residency provision is Ala. Code § 26-10E-5(e)(3).

Home study. Alabama does not waive the home study in stepparent adoptions (Ala. Code § 26-10E-26(2)). Expect a DHR pre-placement investigation as part of the process.

Timeline and cost. Stepparent adoptions in Alabama typically take 3-6 months. Court filing fees run about $200-$350, and the total typical cost is under $1,000. Attorney representation often runs $3,000-$5,000+.
