What is an abandonment affidavit for adoption in Alabama?

In Alabama, an abandonment affidavit is a sworn, notarized written statement, usually from your spouse as the child's parent, describing how the child's other biological parent has been absent. It supports your stepparent adoption petition when you are asking the Probate Court to proceed without that parent's consent.

Alabama's abandonment period: Alabama sets the abandonment period at 4 months (Ala. Code § 26-10E-9(a)(1), (a)(4)). Your affidavit should show clearly how long the other parent has gone without contact or support. How the period applies to your family's particular facts is something the Probate Court clerk in your county or an attorney can confirm.

What a strong affidavit usually covers:

  • The date of the last known contact between the other parent and the child
  • A plain description of the absence: no visits, calls, messages or cards
  • How long the absence has lasted, with dates
  • Whether the parent has provided any financial support
  • Any efforts you or your spouse made to keep the door open to contact
  • Specific, honest details rather than general statements such as "he was never around"

Who signs and how: Your spouse typically signs, in front of a notary, since your spouse is the person with direct knowledge of the other parent's involvement. You may be able to add a supporting statement of your own. Ask the clerk about any local preferences.

Where it fits in the process: The affidavit is one piece of the filing. Alabama's petition package also includes the Petition for Adoption, consent forms or the grounds for implied consent, and your spouse's consent to the adoption. If the child is 14 or older, the child's consent is also part of the picture (Ala. Code § 26-10E-7(a)(1)). The other parent must also receive notice. Alabama allows personal service, or service by publication if that parent's location is unknown. Home study is not waived in Alabama (Ala. Code § 26-10E-26(2)), so the affidavit does not replace that step.

When to get individual advice: If the other parent might contest the adoption, if you are unsure whether the 4-month period is met, or if you can't locate the parent, talk to the Probate Court clerk or an attorney about that specific issue. Those situations depend on the facts.

Costs and timing: Court filing fees in Alabama typically run $200-$350, and the total cost of a stepparent adoption done without an attorney is typically under $1,000, compared with $3,000-$5,000+ with one. Stepparent adoptions here commonly take 3-6 months.
