Can a stepparent adopt without the father's permission in Alabama?

Sometimes, yes. In Alabama, a stepparent can adopt without the father's signed consent when the court file shows grounds for implied consent, such as abandonment, instead. Whether those grounds are met depends on your family's facts, and the Probate Court makes that decision.

How Alabama handles a father who won't or can't sign: An Alabama stepparent adoption petition is filed with either consent forms or grounds for implied consent. If the father will not sign, or cannot be reached, the question becomes whether implied consent applies. Alabama's abandonment provision, Ala. Code § 26-10E-9(a)(1), (a)(4), uses a period of 4 months. Whether the father's situation fits that provision is for the Probate Court to decide, so ask the court clerk or an attorney about your specific facts.

Who else must consent: Your spouse, the child's parent who is married to the adopting stepparent, must consent to the adoption. Alabama also sets a child consent age of 14, under Ala. Code § 26-10E-7(a)(1). Any other question about who must consent in your situation is best confirmed with the Probate Court clerk in your county.

Notice to the father: Even if he doesn't consent, he generally must be told about the case. Alabama allows:

  • Personal service, where he is handed the papers
  • Service by publication, if his location is unknown

Other steps to expect:

  • Home study: Alabama does not waive it for stepparent adoptions (Ala. Code § 26-10E-26(2)). Plan for a DHR pre-placement investigation.
  • Residency: Alabama has no minimum residency period for the adopting family under Ala. Code § 26-10E-5(e)(3).
  • Court: You file in the Probate Court. Alabama has 67 counties, and each county's court may have its own forms and practices.
  • Timeline: A stepparent adoption in Alabama typically takes 3-6 months.

Cost: Court filing fees run about $200-$350. Families typically spend under $1,000 in total when they handle the filing themselves, compared with $3,000-$5,000+ for many attorney-handled adoptions.

If the father objects: If he shows up and contests the adoption, the case becomes more fact-driven and harder to predict. In that situation, speak with an Alabama family law attorney or the Probate Court clerk about how your case would be handled. The same goes if you aren't sure where he is or whether he is legally the father.
