Not always. In Florida, the biological father's written consent is one route to a stepparent adoption, but the law also has a consent waiver and an abandonment provision, so the answer depends on your situation.
How consent works. Florida's consent rules are in Fla. Stat. § 63.062. If the biological father agrees to the adoption, he can sign a written consent, which keeps the case simple. Florida also sets a child consent age of 12 under the same statute, so the child's own consent is part of the picture if your child has reached that age.
If he won't consent or can't be found. Two parts of Chapter 63 may apply:
- Consent waiver: Fla. Stat. § 63.064 covers situations where a required consent may be waived.
- Abandonment: Fla. Stat. § 63.089 addresses abandonment. Florida sets no fixed number of months. Abandonment depends on the parent's overall conduct, not on a countdown.
Whether a judge would find abandonment or waive consent turns on your family's facts: the history of contact, the circumstances, and what the evidence shows. For a contested case, or one where you aren't sure who the legal father is, ask an attorney about your specific situation. The Circuit Court clerk in your county can confirm local procedures.
The Putative Father Registry. Under Fla. Stat. § 63.054, the Florida Putative Father Registry must be searched in each adoption proceeding. This is part of the process whether or not you expect the father to cooperate, and the court orders the search on your request.
What happens to his rights. Under Fla. Stat. § 63.172, a stepparent adoption ends the other parent's parental rights and child support obligations at the same time. Florida does not require a separate termination case for this, so it is handled within the adoption itself. That is also why the father's consent, or the legal basis for going forward without it, matters so much.
