Yes. Pennsylvania sets no minimum residency period before you can file a stepparent adoption, so a recent move does not by itself stop you (23 Pa.C.S. § 2302). You do not have to wait out a waiting period after moving.
What this means for your move:
- You can start the process as soon as your family is ready, rather than counting months in the state.
- Which of Pennsylvania's 67 counties is the right one for your filing, and any local filing steps, are best confirmed with the Orphans' Court clerk in the county where you now live.
- If your child, the other parent, or an earlier court case is connected to another state, the clerk or an attorney can tell you how that affects your situation.
What still matters after a move:
- Consent of the other parent. Pennsylvania requires the other biological parent's consent, or a finding of abandonment. Under 23 Pa.C.S. § 2511, the abandonment period is 6 months. Whether your facts meet that standard is a question for the court, and an attorney can advise you on a contested situation.
- Child's consent. A child who is 12 or older must consent (23 Pa.C.S. § 2711).
- Notice. The other biological parent must receive proper notice. If you cannot locate them, Pennsylvania has procedures for serving notice by publication. If this applies to you, ask the clerk or an attorney how it works in your county.
- Home study. It is waived for stepparent adoptions (23 Pa.C.S. § 2531(c); § 2535(a)), so you do not need to arrange one in your new home.
Timeline and cost: A stepparent adoption in Pennsylvania typically takes 3-6 months. Court filing fees generally run $200-$500, and the typical total cost is under $550. An attorney-handled adoption often costs $3,000-$5,000+.
Getting organized now:
- Gather your marriage certificate and your stepchild's birth certificate.
- Write down what you know about the other parent's contact and involvement, and where they live now if you know.
- Note your new address and the county where you live.
- Contact the Orphans' Court clerk in your county with any questions about local procedures.
Many families move to Pennsylvania for work, to be closer to relatives, or to settle into a new home, and the adoption process doesn't depend on how long you've lived here. Same-sex married couples are also able to pursue stepparent adoption, because Pennsylvania recognizes all valid marriages for this purpose.
