Can I adopt my stepchild if the bio father is in prison for a long sentence in Rhode Island?

Short answer: You can ask the Rhode Island Family Court to approve a stepparent adoption when the biological father is in prison, but whether it can be granted without his agreement depends on the facts of your family's situation. A long sentence is one fact among several, so it is worth understanding how Rhode Island's rules apply.

Abandonment period: Rhode Island's abandonment provision, R.I. Gen. Laws § 15-7-7, uses a period of 6 months. Whether a father's time in prison, his contact with your child, or his support counts under that provision is a question the court decides on the specific facts. For that issue, ask the Family Court clerk in your county or an attorney about your situation.

Does he have to agree? Whether the father must consent, and what happens if he is served and does not respond, is not something we can state as a general rule for every case. If he is willing to sign, that is a different path from a case where he objects or cannot be reached. If he contests the adoption, or you are unsure of his legal status as a parent, talk with an attorney. The Family Court clerk can explain filing procedures, including how papers are delivered to someone in a correctional facility.

Separate termination case: Rhode Island does not treat termination of the other parent's rights as a separate filing in a stepparent adoption. The question of his rights is handled within the adoption case itself.

Your child's consent: If your stepchild is 14 or older, the child's consent is required under R.I. Gen. Laws § 15-7-5(a). If your child is younger than 14, this requirement does not apply on the basis of age.

Residency: Rhode Island has no minimum residency period for this filing (R.I. Gen. Laws § 15-7-4).

Home study: The home study is waived in stepparent adoptions in Rhode Island (R.I. Gen. Laws § 15-7-11), which removes one step that can slow other kinds of adoption.

Court and timeline: Your case is filed in Family Court. Stepparent adoptions in Rhode Island typically take about 3-6 months. A contested case, or one where the father's rights need extra attention, may take longer. Filing fees are set by the court, so the Family Court clerk in your county can confirm the current amount.

Practical points to gather:

  • The father's full name and the facility where he is held, if known
  • Any record of calls, letters, visits, or support since he was incarcerated, and the dates
  • Your child's birth certificate and your marriage certificate
  • Whether your child is 14 or older

Writing down the history of his contact with your child will help you, the clerk, or an attorney see where your case stands.
