Can I adopt my stepchild if I'm in the military stationed in Rhode Island?

Yes, being stationed in Rhode Island does not stop you from pursuing a stepparent adoption of your stepchild in Rhode Island Family Court. Rhode Island sets no minimum residency period for this adoption (R.I. Gen. Laws § 15-7-4), so you don't have to wait out a set number of months after your orders arrive.

Residency and military orders: Because there is no minimum residency period, the question is not how long you have been here. If you want to know how the Family Court treats your address on base or your military orders, ask the Family Court clerk in your county. The clerk can confirm what the court wants to see.

What the process looks like:

  • Court: Your petition goes to the Family Court.
  • Timeline: Stepparent adoptions in Rhode Island typically take 3-6 months.
  • Home study: Rhode Island waives the home study in stepparent adoptions (R.I. Gen. Laws § 15-7-11), which removes one step that can be hard to schedule around duty hours or training.
  • Filing fee: The Family Court clerk in your county can confirm the current amount.

Consent from your stepchild: If your stepchild is 14 or older, their consent is required (R.I. Gen. Laws § 15-7-5(a)). A younger child does not have this consent requirement.

The other biological parent: This is often the part that shapes a case. Rhode Island law refers to a six-month period when a parent has abandoned a child (R.I. Gen. Laws § 15-7-7). Whether your situation fits that, or whether the other parent is contested, unknown or unreachable, depends on the specific facts. For that issue, talk to the Family Court clerk or an attorney who can look at your circumstances.

Military-specific questions: Some questions are particular to service members, such as how a deployment or a transfer could affect scheduling or hearings, protections that may apply if the other parent is also serving, and how your child's benefits change after an adoption. Rhode Island's adoption statutes don't answer these for us. Your installation's legal assistance office, your benefits office, or an attorney can answer them for your situation.
