Yes. In Arizona, any adult resident, whether married, unmarried or legally separated, is eligible to adopt under A.R.S. § 8-103, and being pregnant is not one of the conditions for adopting your stepchild. Many families start while expecting, and the main question is timing.
Eligibility and residency
- You must be an Arizona resident. A.R.S. § 8-103 sets no minimum residency period, so you do not have to wait before filing.
- The case is filed in the Superior Court in your county.
Timing around your due date
- Stepparent adoptions in Arizona typically take 4-8 months. If you want the case moving before the baby arrives, starting early gives you the most room.
- Exact hearing dates are set by the court. Ask the Superior Court clerk in your county how scheduling works if your due date falls while the case is open.
- A new baby does not change the steps below, but a newborn will change your schedule. Build in some extra time.
What the adoption still requires
- Your spouse's consent to the adoption.
- The other legal parent's consent, or a motion to sever that parent's rights. In Arizona, termination of parental rights is handled separately.
- Abandonment: if the other parent has not been involved, A.R.S. §§ 8-531(1), 8-533(B)(1) use a 6-month period. Whether your situation qualifies depends on your facts, so check with the clerk or an attorney, especially if the other parent might contest or cannot be found.
- Your stepchild's consent if the child is 12 or older (A.R.S. § 8-106).
- Fingerprint clearance for adoption petitioners.
- Home study: this is waived in stepparent cases under A.R.S. § 8-105, so you do not have to schedule a home visit during pregnancy.
- Service on the other parent: Arizona allows personal service by a sheriff or process server, or service by publication if the parent's location is unknown after diligent efforts.
Cost
Court filing fees in Arizona run about $200-$350. The total typically stays under $1,000 when you prepare the paperwork yourself, compared with $3,000-$5,000+ for an attorney. Confirm the current fee with your county's Superior Court clerk.
When to get individual advice
If the other parent is unknown, unreachable or likely to contest, the right path depends on your facts. Talk to the clerk or an attorney about that issue before filing.
