Can I adopt my stepchild if I work out of state but live in Rhode Island?

Yes. If your home is in Rhode Island, working out of state does not on its own stop you from adopting your stepchild there. Rhode Island's rule in R.I. Gen. Laws § 15-7-4 is about where you live, and the state sets no minimum number of months of residency before you can file.

What Rhode Island's residency rule looks at:

  • Rhode Island requires residence for a stepparent adoption of a minor, but there is no waiting period. You do not have to live in the state for a set number of months first.
  • The rule is framed around residence, not employment. The statute does not say that an out-of-state job, a commute, or work travel changes anything.
  • If your situation is less clear-cut, for example you split your time between two states or keep a second home elsewhere, the Family Court clerk in your Rhode Island county can tell you how residence is treated. An attorney can advise on your specific facts.

Where you file: Stepparent adoptions of minors go to Family Court in Rhode Island. The clerk's office in your county can confirm the filing fee and local filing details.

Other points that matter if you travel for work:

  • Home study: Rhode Island waives the home study in stepparent adoptions (R.I. Gen. Laws § 15-7-11), so you will not need to schedule home visits around your work schedule.
  • Your stepchild's consent: If your stepchild is 14 or older, the child's consent is required (R.I. Gen. Laws § 15-7-5(a)).
  • The other biological parent: Whether that parent must consent, or whether their rights can be ended because of abandonment, depends on the facts. Rhode Island's abandonment period is 6 months (R.I. Gen. Laws § 15-7-7). If the other parent is absent, unknown, or likely to object, talk with the Family Court clerk or an attorney about that issue.

Timeline: Stepparent adoptions in Rhode Island typically take 3-6 months.

A practical note: Because you may be away from home at times, plan ahead for the hearing date. The court clerk can explain how scheduling works, and a call to the clerk before you file is a good way to avoid surprises.
