Yes. In Iowa you can ask the District Court to let you adopt stepchildren who have different fathers, and each father's situation is addressed on its own. Your relationship to all the children is the same, but each child's biological father may be in a different position, so each one is dealt with separately.
What changes with each father:
- Iowa requires consent forms or a termination petition for the other parent, and termination of rights is a separate step from the adoption itself.
- A father who is willing can sign a consent form. A father who is not involved may need a different approach.
- If a father has abandoned a child, Iowa Code § 600A.8 applies. Iowa sets no fixed number of months for abandonment. It depends on that parent's overall conduct, so the facts of each father's situation matter.
- If a father's location is unknown, Iowa allows service by publication after a diligent search. If you can find him, service can be made personally by a sheriff or process server.
- If a father has died, ask the District Court clerk in your county what proof the court wants for that child.
What stays the same for every child:
- Court: The case is filed in the District Court in your county. Iowa has 99 counties, including those around Des Moines, Cedar Rapids, Davenport, Sioux City and Iowa City.
- Residency: There is no minimum residency period (Iowa Code § 600.3).
- Child's consent: The consent age is 14 (Iowa Code § 600.7), so it matters for any child who is 14 or older.
- Spouse's consent: Your spouse, the child's parent, must consent to the adoption.
- Home study: It is waived (Iowa Code § 600.8).
- Timeline: A stepparent adoption typically takes 3-6 months. Iowa also requires a 180-day period from filing to finalization. If one father's case needs extra steps, such as a termination petition or publication, it can affect timing.
Questions for the clerk or an attorney: The Iowa information we work from doesn't say whether all of your children can go in one petition or need separate petitions, or whether the filing fee is charged once or per child. The District Court clerk in your county can confirm both. Court filing fees generally run $150-$250.
