Can both my spouse and I adopt each other's children from prior relationships in Pennsylvania?

Yes. In Pennsylvania, you and your spouse can each pursue a stepparent adoption of the other's child from a prior relationship, and each adoption follows the same steps as any other stepparent adoption. Pennsylvania recognizes all valid marriages for stepparent adoption purposes, so this applies to same-sex couples too.

How it works: Think of it as a separate stepparent adoption for each child. You adopt your spouse's child, and your spouse adopts yours. Both are heard in the Orphans' Court of your county. Whether the court lets you file together or wants separate petitions, and how it schedules the hearings, is a local question. The Orphans' Court clerk in your county can tell you.

What each adoption involves:

  • The other parent: For each child, the other biological parent's consent is required, and proper notice must be given to that parent. If a parent has abandoned the child, Pennsylvania sets the abandonment period at 6 months (23 Pa.C.S. § 2511). If a parent objects, the adoption can still be granted when abandonment is proven. Paying child support does not by itself prevent an abandonment finding, because courts look at the whole relationship.
  • A parent who can't be found: Pennsylvania has procedures for serving notice by publication.
  • Children age 12 and older: Pennsylvania requires the child's own consent (23 Pa.C.S. § 2711). Each older child gives consent for their own adoption.
  • Residency: There is no minimum residency period. Venue is covered by 23 Pa.C.S. § 2302.
  • Home study: It is waived for stepparent adoptions (23 Pa.C.S. § 2531(c); § 2535(a)).

If the other parent's situation is disputed, unknown, or unclear, that depends on the facts of your case. An attorney or the clerk can advise you on that specific issue.

Timeline: Stepparent adoptions in Pennsylvania typically take 3-6 months. How closely two adoptions can run together depends on your county's scheduling, so ask the clerk.

Court costs: Court filing fees run about $200-$500, and the total typical cost for a stepparent adoption is under $550, compared with $3,000-$5,000+ for an attorney. Ask the clerk whether your county charges a separate filing fee for each petition when two adoptions are filed.

What it means for your family: After the adoptions, each of you has a legal parent-child relationship with every child in your home.
