Can a stepparent adopt without the father's permission in Idaho?

Yes, in many situations a stepparent can adopt in Idaho without the father's permission, but only if the Magistrate Court ends his parental rights or he gives written consent. His absence alone doesn't do it. The court has to act on his rights first.

How it works without his consent: Idaho Code § 16-2005 deals with abandonment, and the abandonment period in Idaho is 12 months. If the father has abandoned the child under that law, the court can terminate his rights. Whether your situation meets that standard depends on your facts. If the father disputes it, or you're unsure whether the 12 months apply to you, ask the Magistrate Court clerk in your county or an attorney about your specific case.

Termination is its own step: In Idaho, ending a parent's rights is handled separately from the adoption itself. If the father won't sign consent, your filing includes a termination petition along with the adoption petition.

If the father is willing: Idaho allows a parent's consent to be signed any time after the child's birth. A signed consent can take the place of a termination petition. Your spouse's consent to the adoption is also part of the filing.

Notifying the father: Idaho allows personal service by a sheriff or process server. If you truly don't know where he is, service by publication is allowed. Ask the clerk what the court expects before using publication.

Other consent to know about: Idaho Code § 16-1504 sets the child's consent age at 12. This is separate from the father's consent, so keep it in mind if your child is that age or older.

Other Idaho basics:

  • Court: Your petition is filed in the Magistrate Court in your county.
  • Residency: Idaho Code § 16-1506(1) sets a residency period of 6 months.
  • Home study: It is waived in stepparent adoptions under Idaho Code § 16-1506.
  • Filing fee: Typically $150-$250, depending on the county. The total cost of a self-filed adoption is typically under $1,000, compared with $3,000-$5,000+ for an attorney.
  • Timeline: Stepparent adoptions in Idaho typically take 3-6 months.
  • Birth certificate: After the adoption is final, the Idaho Bureau of Vital Records and Health Statistics handles the updated record.

When to get individual advice: If the father contests the adoption, or you can't tell whether his rights can be ended, talk to an attorney or the clerk. They can tell you how the court will handle that situation. The same goes for any detail not covered here.
