Yes. In Iowa, a stepparent can ask the District Court to approve the adoption of a child who was born out of wedlock, under Iowa Code Chapter 600. What matters most is where the child's other biological parent stands today, not how the child was born.
What Iowa requires of you
- Residency: Iowa has no minimum residency period (Iowa Code § 600.3).
- Spouse's consent: Your spouse, the child's parent, must consent to the adoption.
- The child's consent: A child who is 14 or older must consent (Iowa Code § 600.7).
- Home study: It is waived in stepparent adoptions (Iowa Code § 600.8).
The other biological parent
Where the child was born outside of marriage, the main question is usually what to do about the other parent's rights. Iowa gives two paths: that parent signs consent forms, or you file a termination petition. Termination is a separate step from the adoption itself.
If the other parent has been absent, Iowa sets no fixed number of months for abandonment. The court looks at that parent's overall conduct (Iowa Code § 600A.8).
Notice to the other parent
Iowa allows personal service by a sheriff or process server. If the parent's location is unknown, it allows service by publication after a diligent search.
If the father isn't on the birth certificate, or is unknown
How Iowa law treats a father who was never named, never established paternity, or can't be identified depends on the facts of your situation. Please confirm that point with the District Court clerk in your county or with an attorney. For birth certificate records, the agency to contact is the Iowa Department of Public Health Vital Records.
Timeline and cost
- Iowa requires a 180-day period from filing to finalization. Stepparent adoptions typically take 3-6 months overall, and the clerk can confirm how this applies to your case.
- Court filing fees run about $150-$250.
- The total typical cost is under $1,000 when you file on your own, compared with $3,000-$5,000+ for many attorney-handled adoptions.
When to get individual help
If the other parent may object, can't be found, or has never been identified, ask an attorney or the clerk about your specific situation before you file. These cases depend on the facts, and a general answer can't settle them.
