What if the biological parent sends a gift but has no other contact — is that abandonment in Louisiana?

3 min readHelping families since 2001Louisiana

Louisiana sets an abandonment period of six months in La. Ch.C. Art. 1245, but whether a gift with no other contact meets it is something the District Court decides based on your family's specific facts. A gift alone does not give you a automatic yes or no, so it helps to understand what the court will want to see.

Why the gift matters. A gift is a form of contact, and the other parent may point to it to show they stayed involved. How much weight it carries is a judgment for the judge. If the other parent contests the adoption, or if you are unsure how the gift will be viewed, an attorney can advise you on your situation. The clerk of the District Court in your parish can also tell you how the filing process works.

Build a clear record. Whatever the legal outcome, a written timeline helps. Gather:

  • The date of the gift, what it was, and how it arrived (mail, delivery, handed to someone else)
  • Any message that came with it, and whether the child responded
  • The last date of any visit, call, text, or video chat before the gift
  • Any other contact, support, or attempts to reach the child during the six-month window, or the absence of them
  • Any efforts you or the child's other parent made to keep the biological parent informed or involved

Keep it factual. Dates and specifics are more useful than conclusions.

Think about the whole picture. Because the six-month period in Art. 1245 is measured over time, one gift should be viewed alongside everything else that happened in that stretch. Gather everything about the parent's involvement, not just the gift.

The child's voice. Louisiana does not require the child's consent to a stepparent adoption. The court does ask for and consider the wishes of a child 12 or older, so it's worth thinking about how you will talk with an older child about the process.

Other parts of the process. Your case is filed in the District Court. The home study is waived under La. Ch.C. Art. 1252(A), and stepparent adoptions in Louisiana typically take 3-6 months. Court filing fees generally run $200-$400, and the typical total cost is under $1,000, compared with $3,000-$5,000+ for an attorney.

When to get legal help. If the biological parent is likely to object, shows up in court, or you disagree about what counts as contact, speak with a Louisiana attorney before filing. Questions about how a judge treats a particular gift or gesture should be confirmed with the District Court clerk or an attorney.
