What if the biological father refuses to consent to adoption in Louisiana?

A father's refusal to consent does not automatically end a stepparent adoption in Louisiana, but what happens next depends on the facts of your situation and on the judge. The main legal question is usually whether he has abandoned the child, and Louisiana uses a 6-month period for that in La. Ch.C. Art. 1245.

How abandonment fits in. If the father has not stepped into the child's life for the abandonment period, that is the provision your petition would point to. Louisiana does not treat termination as a separate step. The question is raised within your adoption case in the District Court. Whether his objection is set aside is for the judge to decide on the evidence.

What the court is likely to look at. The facts matter more than what he says when asked to sign. It helps to gather your own records of:

  • When he last saw the child
  • When he last called, wrote or otherwise contacted the child
  • Whether he has paid any support
  • Any messages or paperwork showing his response when you raised the adoption

If he is actively involved. If the father is part of the child's life and opposes the adoption, the case is contested, and the outcome is harder to predict. A contested case is also the point to talk with a Louisiana family law attorney about your specific facts. Timing can differ too. The typical stepparent adoption timeline here is 3-6 months, and the District Court clerk in your parish can tell you how contested matters are scheduled.

If you can't find him. Louisiana allows personal service by the sheriff. If his location is unknown after real, documented efforts to find him, service by publication is allowed. Keep a record of every effort you make, because the court will want to see it.

What stays the same. Your filing is made in the District Court of your parish. Louisiana has no minimum residency duration, though you must be domiciled in the state, meaning it is your permanent home (La. Ch.C. Art. 1180). The court does not require the child's consent, but it asks for and considers the wishes of a child 12 or older. The court filing fee typically falls between $200 and $400, and total costs often stay under $1,000, compared with $3,000-$5,000+ for an attorney. Your clerk can confirm the current fee for your parish.

What to do first.

  • Write down the timeline of the father's contact and support, with dates.
  • Save texts, emails, court orders and any support records.
  • Ask the District Court clerk what the court expects when a parent does not consent.
  • Consider a short attorney consultation if you expect him to show up and fight.
