What if the biological parent sends a gift but has no other contact — is that abandonment in Alabama?

A single gift doesn't automatically decide the question in Alabama. Whether it counts as abandonment depends on the full facts of your situation, and the Probate Court makes that call. There is no simple rule that a gift either proves or erases abandonment, so it helps to understand how the issue fits into your case.

Where abandonment comes in. Alabama's abandonment provision, Ala. Code § 26-10E-9(a)(1), (a)(4), uses a period of 4 months. If the other biological parent will not sign a consent, the grounds for implied consent become the question. The petition includes either consent forms or the grounds for implied consent.

Why a gift raises questions. A gift is one data point among many. Details that may matter include:

  • When the gift was sent and what it was
  • Whether it came with any message to the child, or was sent through you
  • Whether there was any calling, visiting, or other contact before or after it
  • Whether the parent supported the child in other ways
  • Whether you or the child ever tried to reach out, and what happened

How a judge weighs a gift against the rest of the history is not something we can predict. If this is contested, the Probate Court clerk in your county or an Alabama family law attorney can tell you how that specific fact pattern is likely to be handled.

What you can do now.

  • Write down the date, description, and circumstances of the gift while you remember them.
  • Build a simple timeline of every contact, or lack of contact, over the past several years. Include calls, texts, cards, visits, and any support.
  • Save screenshots, postmarks, and messages that show what was and wasn't sent.
  • Note any attempts you made to keep the parent involved.

An honest, complete record serves you better than leaving out the gift. The court will see the whole picture either way.

If the parent objects or can't be found. A parent who has sent a gift may still be reachable, and Alabama allows personal service on them. If you truly don't know where the parent is, service by publication is allowed when the location is unknown. A parent who receives notice and contests the adoption makes it a fact-specific dispute, and that is the point to talk with an attorney.

What to expect on timing and cost. Stepparent adoptions in Alabama typically take about 3-6 months. Court filing fees run about $200-$350, and a home study is not waived (Ala. Code § 26-10E-26(2)). Your petition is filed in the Probate Court, and the clerk in your county can confirm local procedures.
