What documents do I need for stepparent adoption in Texas?

For a Texas stepparent adoption of a minor child, prepare the adoption petition and the documents needed for your actual parentage, consent, notice and evaluation route. There is no reliable universal checklist in which an absent parent is handled simply by swapping a consent form for an “abandonment affidavit.” The court must make the applicable legal findings.

Organize a Texas case file

Part of the fileWhat to prepare or provideWhat to confirm
Family recordsNames, birth information, marriage details and relevant existing orders.Accurate facts and all prior or ongoing cases.
PetitionRequired petitioners, allegations and supporting documents.Chapter 162 requirements and local filing instructions.
Parental-rights routeApplicable orders, consents or termination papers.Which legal relationship must be addressed and how.
Notice and serviceRequired issued papers and delivery proof.Recipients, lawful method and filing of proof.
Evaluation or records reviewReport or court-approved waiver and required records. The actual court decision and deadlines.
Hearing and final orderCourt-required papers and proposed order.Attendance, completion of prerequisites and judge's findings.

Give the preparer the existing orders

Gather relevant custody, parentage, guardianship and other orders, including any prior termination order. Note case numbers, courts and unresolved proceedings. Do not characterize a parent as having no rights merely because contact is limited or the birth certificate omits a name.

Keep a list of missing records. Ask the filing court or preparer whether certified copies are needed for particular items; a records-organizing checklist is not proof that every court requires the same attachments.

Check who joins and what the petition must say

Texas Family Code §162.002 requires both spouses to join when the petitioner is married. It also specifies a verified statement about compliance with Subchapter B or the particular reasons for noncompliance. Obtain help with the statement applicable to the actual case rather than copying an unsupported declaration.

Section 162.001 addresses the conditions for adopting a child and the relationship between adoption and termination. The continuing parent who is married to the petitioner has a different role from the other parent. A prior order or required termination proceeding must be assessed accurately; an informal agreement is not a universal replacement.

Under §162.010, a managing conservator's consent, the joining parent's role and the child's consent are separate issues. A child aged 12 or older must consent in writing or in court unless the court grants the stated best-interests exception.

Track required notice and service separately from those consents. Ask how papers are issued, who can deliver them and what proof must be filed. Obtain legal help for disputed termination, parentage or notice instead of assuming that newspaper publication is automatically available when someone cannot be found.

Document the evaluation decision

Section 107.153 allows a discretionary evaluation waiver in an uncontested stepparent case after the specified department-records and criminal-history review. A request alone does not establish a waiver. Retain the court's order and complete any required review or report.

Section 162.009's six-month residence-with-petitioner requirement has a best-interests waiver provision. Supply accurate placement dates and the relevant court decision rather than claiming a blanket six-month state-residency rule. Follow the Texas filing roadmap to organize the remaining stages.

Prepare the final hearing folder

Collect accepted filings, required consents, service proof, evaluation or waiver records, existing orders and the court's hearing instructions. Confirm attendance under §162.014 and the papers needed for findings under §162.016. The judge decides the adoption; the proposed order is not already a decree.

Use the Texas cost guide for a separate fee checklist and start the Texas questionnaire with the real records available. The general organizer helps track the folder. Distinct California and Alaska guides cover those jurisdictions.
