How do I file for stepparent adoption in Texas?

To file a Texas stepparent adoption, identify the correct court and venue, address the existing parent-child relationships, prepare the petition and complete the required court process. Adoption and termination findings are legal decisions for the judge. A parent's absence or the family's agreement does not automatically satisfy every prerequisite.

Organize a Texas filing roadmap

StageWhat the case needs
Venue and courtA court with jurisdiction and the proper county.
Existing parentageRelevant orders and the other parent's legally applicable route.
Petition and consentsCorrect petitioners, required consent and supporting papers.
Evaluation and recordsRequired evaluation or an approved statutory waiver.
Hearing and final orderAttendance, proof of requirements and the judge's findings.

Confirm the county and disclose existing cases

Texas Family Code §103.001(b) allows an adoption suit in the county where the child or petitioners reside. Existing continuing-jurisdiction and transfer questions may still matter. Provide every relevant custody, parentage or support order and confirm the court and submission procedure with the appropriate clerk.

Do not borrow the adult-adoption venue rule for a minor-child case. If the person to be adopted is already an adult, use the Texas adult-adoption cost and procedure guide instead.

Chapter 162 addresses when a child may be adopted and the petition requirements. For a married petitioner, both spouses join. The continuing parent who is the petitioner's spouse has a different role from the other parent whose relationship may need to be terminated.

Section 162.010 requires consent from a child aged 12 or older, in writing or in court, unless the court grants the stated best-interests exception. The child's consent does not replace the separate parental-rights work. Obtain legal help for contested termination or disputed parentage instead of assuming that limited support or contact establishes a particular ground.

Prepare the petition, notice and fee budget

Provide the child's and petitioners' information, existing orders and legally required attachments. Follow the appropriate signing and verification instructions. Confirm the required notice or service, who may deliver it and how proof is filed; publication is not an automatic substitute for locating a parent.

The reviewed Texas filing-fee guide separates Harris County's adult and minor-adoption entries and additional charges. Ask your county for an itemized amount and any applicable inability-to-pay procedure. Our $349 preparation price, with $99 per additional adoptee in the same case, does not pay the clerk or investigator.

Obtain the court's evaluation decision

Section 107.153 permits an evaluation waiver in an uncontested stepparent case under specified conditions, including review of department investigative records and criminal-history information. It is not an automatic exemption for every stepparent. The section also addresses payment of the evaluation or records-review costs.

Under §162.009, the child's six-month residence with the petitioner can be waived by the court in the child's best interests. That is different from a blanket six-month Texas-residency rule. Record what your actual orders require before requesting finalization.

Prepare for the judge's decision

Confirm attendance, the completed evaluation or waiver, consents and proof of notice with the court. Sections 162.014 and 162.016 address attendance and the findings for an adoption order. Follow the actual hearing date; no universal delivery promise establishes when the court will finish.

Use the representation guide if you need legal advice. For preparation, start the Texas questionnaire with the real circumstances. A different jurisdiction requires its own California or Alaska filing path.
