Can the biological parent change their mind after consenting to adoption in Texas?

1 min readHelping families since 2001Texas

In Texas, once a biological parent signs a voluntary consent to adoption, there is typically a very limited window to revoke that consent — and in many cases, consent becomes irrevocable once signed or shortly after.

The specifics vary, but generally:

  • Consent signed before a judge or notary is binding
  • Some states allow a brief revocation period (typically 10–30 days)
  • Once the adoption is finalized by the District Court, it is permanent and cannot be reversed

This is why the consent process is taken seriously — the court wants to make sure the biological parent understands what they're signing. We prepare proper consent forms that meet all Texas legal requirements, ensuring they'll hold up in court.

In our 25+ years and 34,000+ adoptions, we've seen very few cases where a parent tried to revoke consent, and even fewer where it succeeded. The finalization hearing is the point of no return.
