Do I have to wait after getting married before I can adopt my stepchild in Ohio?

No. The Ohio requirements we work from do not set a waiting period after you marry before you can start a stepparent adoption, and Ohio has no minimum residency period (ORC § 3107.04). Because every family's situation is a little different, the Probate Court clerk in your county can confirm there is nothing else to wait for before you file.

What this means for your timing:

  • Residency: Ohio has no minimum residency period, so a recent move to Ohio does not by itself hold you back. Under ORC § 3107.04, the county where you file can be where the child was born, or where you, the child or the child's parent lives when you file.
  • Length of marriage: Nothing in the Ohio information we use sets a minimum number of months or years of marriage before you file. If you want to be sure about this point for your county, ask the clerk.
  • The court: Stepparent adoptions are handled by the Probate Court in one of Ohio's 88 counties.

What does take time after you file:

  • Overall timeline: A stepparent adoption in Ohio typically takes about 3-6 months.
  • Court appearance: Finalization requires a brief court appearance.
  • Home study: Ohio has a home study provision (ORC § 3107.031). Ask the clerk how it applies to your case so you can plan for it.
  • Court filing fees: Fees usually run $200-$500, depending on the county.
  • Your stepchild's age: Ohio sets a child consent age of 12 (ORC § 3107.06). If your stepchild is 12 or older, plan to talk with them about the adoption.
  • The other legal parent: Whether that parent consents, or whether the adoption can go forward without consent, depends on the facts. Ohio's abandonment period is 12 months (ORC § 3107.07), but whether it applies to your family is a question for the clerk or an attorney. This is especially true if the other parent might contest the adoption or you do not know where they are.

A practical way to think about it: The date of your wedding is not the main thing to watch. Your own documents, the other parent's situation and your county's process matter more. Gathering your paperwork now means you can file as soon as you are ready.
