How old do you have to be to adopt in Ohio?

In Ohio, you must be at least 18 to adopt as an unmarried adult, and a married couple adopting together needs only one spouse to be an adult (R.C. 3107.03). Ohio defines an adult as someone 18 or older (R.C. 3107.01(M)). For a stepparent adoption, that means the age requirement is usually easy to meet.

Minimum age. An unmarried adopter must be 18 or older. If you and your spouse are adopting together, only one of you has to be an adult under R.C. 3107.03.

Age gap between you and the child. The Ohio information we work from does not set an age gap. During the home study (ORC § 3107.031), the assessor may not consider your age as long as you are old enough under R.C. 3107.03. The same material does not address a maximum age. If that is your concern, the Probate Court clerk in your county or an attorney can confirm how it applies to you.

Other ages that come up in a stepparent adoption.

  • The child's age: Ohio sets age 12 for a child's consent (ORC § 3107.06). If your stepchild is near that age, expect it to matter in your case.
  • Your age versus the process: Your age does not change the steps. You still file in the Probate Court, and Ohio requires a brief court appearance to finalize.

Other Ohio basics that affect eligibility.

  • Residency: Ohio has no minimum residency period (ORC § 3107.04), so a recent move does not hold you back.
  • Home study: It is not waived in Ohio, and ORC § 3107.031 governs it.
  • Timeline: Stepparent adoptions typically take about 3-6 months.
  • Court costs: Filing fees generally run $200-$500, depending on the county.

Situations that depend on your facts. Meeting the age requirement does not settle everything. Whether the other parent must consent, what happens if the other parent cannot be found, and how a contested case is handled all depend on your circumstances. Ask the Probate Court clerk in your county, or an attorney, about those specific issues.
