Do I have to wait after getting married before I can adopt my stepchild in Minnesota?

Minnesota's rules tie your timing to how long you have lived in the state, not to how long you have been married, so the wait you need to plan around is the residency period. If your situation involves a recent wedding, the District Court clerk in your county can confirm whether anything else applies to your marriage date.

Residency is the timing rule to check.

  • Under Minn. Stat. § 259.22, the residency period is 1 year.
  • The court may shorten it to 30 days, and it may waive it for a stepparent.
  • If you recently moved to Minnesota, this is the period that matters most. If you have lived here for a year or more, residency should not hold you up.
  • Whether the court shortens or waives the period in your case is the court's decision, so ask the clerk how it handles requests.

Waiting after the wedding.

  • Minnesota's residency rule is the only timing requirement we can point to in the statutes we work from.
  • If you want to be certain nothing else applies to a recent marriage, call the District Court clerk in the county where you live or speak with a family law attorney.

What the timeline looks like once you file.

  • A stepparent adoption in Minnesota typically takes 3-6 months.
  • Minnesota waives the home study in stepparent adoptions (Minn. Stat. § 259.41), which keeps one step off your timeline.

Other items that affect timing.

  • If your child is 14 or older, the child's consent is part of the process (Minn. Stat. § 259.24), so plan for that conversation early.
  • If the other parent's rights are an issue, the facts of your situation matter a great deal. Minnesota's abandonment period is 6 months (Minn. Stat. § 260C.301), but whether it applies to you depends on your circumstances. That is a question for an attorney or the court clerk.

Where to file. Adoption cases are filed in your county's District Court. Filing fees and local procedures vary by county, so the clerk can confirm the current amount and any local requirements.
