Can my spouse adopt my child from a previous relationship in Ohio?

Yes. In Ohio, your spouse can petition to adopt your child from a previous relationship through the Probate Court in your county. This is what stepparent adoption is for, and once it is finalized your spouse becomes the child's legal parent.

What Ohio requires

  • Residency: Ohio has no minimum residency period (ORC § 3107.04), so a recent move to Ohio does not hold you back.
  • The other legal parent: This is usually the biggest question. The other parent's consent is normally part of the process. If that parent has abandoned the child, the case may rest on Ohio's 12-month abandonment period (ORC § 3107.07). Whether your situation fits depends on the facts.
  • Your child's consent: Ohio sets the child's consent age at 12 (ORC § 3107.06). If your child is 12 or older, their own consent matters.
  • Home study: Ohio does not waive the home study for stepparent adoptions. See ORC § 3107.031.

If the other parent is missing or objects

Ohio has procedures for cases where the other parent cannot be found. A parent who objects, or whose whereabouts are unknown, makes the case fact-specific. Ask the Probate Court clerk in your county how that step works, or talk with an attorney about your particular situation.

What the process looks like

  • You file a petition in the Probate Court of your county. Ohio has 88 counties, and each court has its own local forms and practices.
  • Ohio requires a brief court appearance to finalize a stepparent adoption.
  • The typical timeline is 3-6 months.
  • Court filing fees typically run $200-$500. The clerk can confirm the exact amount for your county.
  • After finalization, the Ohio Department of Health Office of Vital Statistics is the agency to ask about your child's birth record.
