Can my spouse adopt my child from a previous relationship in Kentucky?

Yes, in Kentucky your spouse can adopt your child from a previous relationship through the Circuit Court in your county. Stepparent adoption is a well-worn path, and Kentucky has several features that make it more manageable for families.

Residency. Kentucky has no waiting period for residents. If you live in Kentucky, you don't have to wait before filing. Non-residents need 12 months in the state (KRS § 199.470).

The other parent's role. The court needs to know where the child's other legal parent stands, and there are two main routes:

  • Consent: The other parent signs consent forms.
  • Motion to dispense with consent: If the other parent has had no contact, Kentucky has one of the shorter abandonment periods. Just 3 months (90 days) of no contact can establish grounds for proceeding (KRS § 199.502).

If the other parent objects, or the facts are unclear, that is a situation for an attorney or the Circuit Court clerk, because the outcome depends on your family's circumstances.

Your child's consent. Kentucky sets the child consent age at 12 (KRS § 199.500). If your child is near that age, ask the clerk or an attorney how it applies to your case.

Home study. Kentucky waives the home study for stepparent adoptions (KRS § 199.473), so you won't need to schedule one.

Paperwork you can expect.

  • A Petition for Adoption
  • Consent forms, or a motion to dispense with consent
  • Your spouse's consent to the adoption
  • Criminal background checks through the Kentucky State Police for the adoption petitioners

Notifying the other parent. Kentucky allows personal service by a sheriff or process server. If the other parent's location is unknown, service by publication is allowed after a diligent search. Your county clerk can explain what counts as a diligent search.

Timeline and cost. Stepparent adoptions in Kentucky typically take 3-6 months. Court filing fees generally run $150-$300, and the total cost when you handle the filing yourself is typically under $1,000. Hiring an attorney commonly costs $3,000-$5,000+.

After the adoption. Once the court finalizes the adoption, your spouse becomes your child's legal parent. For questions about updating your child's birth record, contact the Kentucky Office of Vital Statistics.

Where to file. Kentucky has 120 counties, and each has its own Circuit Court clerk's office. Local procedures and forms can vary, so it helps to confirm details with your clerk, whether you live in Louisville, Lexington, Bowling Green, Owensboro, Covington, or a smaller community.
