Can my spouse adopt my child from a previous relationship in Virginia?

Yes, your spouse can adopt your child from a previous relationship in Virginia. This is called a stepparent adoption, and it is handled by the Circuit Court in your county or city under Code of Virginia Title 63.2, Chapter 12.

Who can petition. Virginia law lets any natural person who resides in the Commonwealth petition to adopt a minor (Va. Code § 63.2-1201). There is no minimum residency period, so your spouse does not have to live in Virginia for a set number of months first. The petition is filed in the Circuit Court where your family lives.

Consent. Consent is a central part of the paperwork, and Virginia's court forms include consent forms as well as a motion to dispense with consent. You can expect to deal with these:

  • Your spouse's consent to the adoption is part of the filing.
  • Your child's consent is tied to age 14 (Va. Code § 63.2-1202).
  • The other parent's consent is handled with a consent form. If that parent does not consent, the filing may instead include a motion to dispense with consent.
  • Abandonment is addressed in Va. Code § 63.2-1202(H), which uses a 6-month period. Whether your situation meets it depends on your facts, so ask the Circuit Court clerk or an attorney.

If the other parent is hard to find. Virginia allows personal service on the other parent. If you do not know where that parent is, service by publication is allowed after a diligent search. Contested cases and unknown-parent situations depend heavily on the details, so an attorney is the right person to advise you on those.

Home study. Virginia waives the home study for stepparent adoptions (Va. Code § 63.2-1242). Many families find this keeps the process simpler.

Military families. Virginia has special provisions for military parents. If that applies to you or the other parent, ask the clerk how it affects your filing.

Timeline and cost. A stepparent adoption in Virginia typically takes 3-6 months. Court filing fees run about $150-$300, and the total cost is typically under $1,000 when you file without an attorney. Attorney-handled adoptions commonly run $3,000-$5,000+. Your Circuit Court clerk can confirm the exact fee for your county or city.

If your child is already an adult. Virginia also permits adoption of a stepchild who is 18 or older, if the stepparent has stood in loco parentis for at least 3 months. These cases typically move faster, in about 4-8 weeks, and the adult's own consent is required.
