Can I adopt my stepchild in North Dakota if I was previously married to someone else?

Yes. A previous marriage is not one of the requirements in North Dakota's stepparent adoption rules (North Dakota Century Code Chapter 14-15), so you can pursue adopting your stepchild. If you have a specific question about how your marital history fits your case, the District Court clerk in your county can confirm it.

What the District Court looks at. Your stepparent adoption is filed in the District Court in your county. The requirements North Dakota sets out concern the adoption itself:

  • Residency: North Dakota has no minimum residency period for filing (N.D.C.C. § 14-15-04).
  • Your child's consent: A child who is 10 or older must consent to the adoption (N.D.C.C. § 14-15-05).
  • The other parent: Their consent, or a showing of abandonment, is part of the process. The abandonment period in North Dakota is 12 months (N.D.C.C. § 14-15-19).
  • Home study: North Dakota waives the home study for stepparent adoptions (N.D.C.C. § 14-15-11).

If your child's other parent is a former spouse of yours. Some blended families have a more complicated history, such as a child from an earlier relationship or an ex-spouse who is still involved. Whether the other parent will consent, and what happens if they don't, depends on the facts of your situation. For a contested case or an unknown or unreachable parent, talk to an attorney or the District Court clerk about that issue before you file.

Filing details. North Dakota has 53 counties, and the exact filing fee and any local paperwork preferences are set by the District Court clerk in your county. A call to the clerk's office is a good way to confirm them.

Timeline. A stepparent adoption in North Dakota typically takes 3-6 months, depending on your county's schedule and whether everyone's consents are in order.

Your history and your role. What matters to your family right now is the relationship you've built with your stepchild. Adoption makes that relationship legal, and a previous marriage is not a listed obstacle to it.
