Can I adopt my stepchild in South Dakota if I was previously married to someone else?

Very likely yes. South Dakota allows "any adult person" to adopt a minor child (SDCL 25-6-2), and that rule says nothing about whether you were married before. Whether a past marriage affects your particular case, or what paperwork the court wants about it, is something the Circuit Court clerk in your county or an attorney can confirm.

What the law does address for a married adopter:

  • A married person who wants to adopt a child needs the spouse's consent, unless the spouse is lawfully separated from them or cannot consent (SDCL 25-6-3). In a stepparent adoption, that spouse is your husband or wife, the child's parent.
  • If you have an ex-spouse, how that history applies to your situation is a question for the clerk or an attorney.

Other South Dakota points that matter in a stepparent adoption:

  • Court: Your petition is filed in the Circuit Court in your county.
  • Residency: South Dakota sets no minimum residency period before you file.
  • Child's consent: A child who is 12 or older must consent (SDCL § 25-6-5).
  • Abandonment: If the other biological parent has abandoned the child, the period is 6 months (SDCL § 25-6-4(2)). If that parent is contesting the adoption, can't be found, or the facts are unclear, ask the clerk or an attorney about your specific situation.
  • Age difference: For a minor child, the adopter must be at least 10 years older than the child, unless the court finds the adoption is in the child's best interest (SDCL 25-6-2).
  • Home study: It is waived for stepparent adoptions (SDCL § 25-6-10).

Timeline: A stepparent adoption in South Dakota typically takes about 3-6 months. The clerk can tell you the current filing fee and local procedures.

Your history and your role now: A first marriage, a divorce, or a blended family with several parents involved is not unusual. What the court will want to see is that you are the child's stepparent now, that the right people have consented or that consent isn't required, and that the adoption fits the child's situation. Gather the dates and documents related to any earlier marriage, and ask the clerk whether the court wants copies.
