Yes, you can ask a Louisiana District Court to approve a stepparent adoption even when your stepchild spends part of their time with the other biological parent, but how that parent fits into your case depends on the facts of your situation. Part-time living arrangements are where the details matter most.
Where the other parent's role comes in. Louisiana's abandonment rule is La. Ch.C. Art. 1245, and it uses a 6-month period. A parent who has regular time with your child is in a very different position from one who has been out of the picture. Whether the other parent must consent, and how the court treats a parent who shares custody or visitation, is a question for the District Court clerk in your parish or for an attorney. This is especially true if the other parent might object.
What Louisiana does and doesn't require:
- Residency: There is no minimum residency period (La. Ch.C. Art. 1180). You do need to be domiciled in Louisiana, meaning it is your permanent home.
- Child's consent: Louisiana does not require your stepchild's consent. The court asks for and considers the wishes of a child 12 or older (La. Ch.C. Art. 1253(C)).
- Home study: It is waived for stepparent adoption (La. Ch.C. Art. 1252(A)).
- Paperwork: The filing starts with a Petition for Intrafamily Adoption and includes a sworn statement of financial responsibility. It also includes your spouse's consent to the adoption.
- Notifying the other parent: Louisiana allows personal service by sheriff. If a parent's location is unknown, it allows service by publication after due diligence.
Practical paths to consider:
- Talk with the other parent. If they are involved and supportive, the process may be simpler. Their agreement is something to settle, in writing and with the court's process, so ask the clerk how it is handled in your parish.
- Clarify your custody arrangement. Have any existing custody or visitation orders on hand when you speak with the clerk or an attorney.
- Get an attorney for a contested case. If the other parent objects, the case depends on facts specific to your family. That is the point to bring in an attorney who can advise you directly.
Timeline and cost. Louisiana stepparent adoptions typically take 3-6 months. Court filing fees run about $200-$400, and the total cost is typically under $1,000, compared with $3,000-$5,000+ when hiring an attorney. Your clerk can confirm the exact fee in your parish, whether you are in New Orleans, Baton Rouge, Shreveport, Lafayette, Lake Charles or any of Louisiana's 64 parishes.
