Can I adopt my stepchild if they live with the other biological parent part-time in Alabama?

Possibly, yes. In Alabama, a child spending part of their time with the other biological parent does not by itself stop a stepparent adoption in the Probate Court. What matters is whether that parent gives consent or whether the court finds legal grounds to go forward without it.

Consent is the central question. Alabama's stepparent process requires either consent forms from the parent or grounds for implied consent. Your spouse, the child's parent, must also consent to the adoption. If the other parent stays actively involved in the child's life, the simplest path is usually a signed consent. Whether a part-time custody or visitation schedule affects the grounds for implied consent depends on your facts, so an attorney or the Probate Court clerk in your county should answer that for your situation.

Abandonment is a separate ground. Alabama's abandonment provision, Ala. Code § 26-10E-9(a)(1), (a)(4), uses a four-month period. Whether a parent who has the child part-time could ever fall under it is a fact-specific question. Do not assume it applies. If the other parent objects, the case may become contested, and you should speak with an attorney about that specific issue.

Other Alabama points that apply to you:

  • Court: Your petition goes to the Probate Court. Alabama has 67 counties, and each has its own clerk who can explain local filing steps.
  • Child's consent: A child who is 14 or older must consent. The rule is in Ala. Code § 26-10E-7(a)(1).
  • Residency: Alabama sets no minimum residency period for this adoption (Ala. Code § 26-10E-5(e)(3)).
  • Home study: It is not waived in Alabama (Ala. Code § 26-10E-26(2)). Expect a DHR pre-placement investigation as part of the process.
  • Finding the other parent: Alabama allows personal service, and service by publication if the parent's location is unknown.
  • Timeline: Stepparent adoptions typically take 3-6 months.
  • Costs: Court filing fees run $200-$350, and the total typically comes to under $1,000 when you file without an attorney. Attorney-handled adoptions are often $3,000-$5,000+.
  • Updated records: After the adoption is final, the Alabama Center for Health Statistics handles the vital records side.

What to do next:

  • Talk with your spouse about the other parent's likely position.
  • If you think they may agree, a respectful conversation about the child's stability and your role can help.
  • If you expect a dispute, or the parent's involvement is changing, consult an attorney before filing.
  • Keep any written records of the parenting schedule, since they may matter to the court.
