Can I adopt my stepchild if the bio parent is in jail in Louisiana?

Yes, you can ask a Louisiana District Court to approve a stepparent adoption even when your stepchild's biological parent is in jail, though how the case unfolds depends on that parent's situation and how they respond.

Being incarcerated is not the only thing the court looks at, so here is what Louisiana's rules tell us.

Abandonment. Louisiana's abandonment provision, La. Ch.C. Art. 1245, uses a 6-month period. Whether time in jail counts, and what contact the parent kept with your child, are fact-specific questions. The District Court clerk in your parish or an attorney can tell you how that applies to your case.

Where you file. You file in the District Court. Louisiana has 64 parishes, and each handles filings through its own clerk's office. That includes parishes around New Orleans, Baton Rouge, Shreveport, Lafayette and Lake Charles.

Residency. Louisiana has no minimum residency period for this adoption (La. Ch.C. Art. 1180), so you do not have to wait out a set number of months before filing.

Your stepchild's voice. Louisiana does not require the child's consent. The court asks for and considers the wishes of a child 12 or older (La. Ch.C. Art. 1253(C)).

Home study. A home study is waived (La. Ch.C. Art. 1252(A)), which can keep things simpler.

Notifying the parent. The incarcerated parent must be formally notified of the case. Louisiana allows personal service by the sheriff, and service by publication if a parent's location is unknown after due diligence. Because your stepchild's parent is in a correctional facility, ask the clerk how service works for someone in custody in your parish.

If the parent agrees or objects. A parent who cooperates and a parent who fights the adoption lead to very different cases. If the parent contests, or if there are other questions about who must be notified or give consent, talk to an attorney about your specific situation.

What you will file. Louisiana's intrafamily adoption paperwork includes:

  • A Petition for Intrafamily Adoption
  • A sworn statement of financial responsibility
  • Your spouse's consent to the adoption

Time and cost. Stepparent adoptions in Louisiana typically take 3-6 months. Court filing fees run about $200-$400, and the typical total cost is under $1,000. Attorney-handled adoptions often run $3,000-$5,000+.
