Can I adopt my stepchild if the bio parent is in jail in Kentucky?

Yes, you can file a stepparent adoption in a Kentucky Circuit Court even if your stepchild's other biological parent is in jail. What matters is how that parent responds and what the court decides about their consent.

Two paths: consent or no consent. Kentucky adoption filings include a Petition for Adoption, along with either consent forms or a motion to dispense with consent. If the incarcerated parent is willing to sign consent, that is the simpler route. If they won't sign, or you can't get their signature, the motion to dispense with consent is how you ask the court to proceed without it.

Abandonment and the 90-day mark. Kentucky has one of the shorter abandonment periods: 3 months (90 days) of no contact can establish grounds for proceeding (KRS § 199.502). If the parent has not written, called, visited or otherwise kept in touch with your stepchild for that long, that may matter to your case. Whether time spent in jail counts toward that period, and how the judge weighs the parent's circumstances, depends on your facts. Please confirm that point with the Circuit Court clerk in your county or an attorney.

Notifying the parent. Kentucky allows personal service by a sheriff or process server. If you truly don't know where the parent is, service by publication is allowed after a diligent search. Where a parent is held can change, so the clerk can tell you what the court expects for your situation.

Other Kentucky requirements that apply to you:

  • Residency: There is no waiting period for Kentucky residents. Non-residents need 12 months in the state (KRS § 199.470).
  • Your spouse's consent: Your spouse, the child's parent, must consent to the adoption.
  • Child's consent: If your stepchild is 12 or older, their consent is part of the process (KRS § 199.500).
  • Background check: Petitioners need a criminal background check through the Kentucky State Police.
  • Home study: It is waived in stepparent adoptions (KRS § 199.473).
  • Separate termination case: Kentucky does not require one for a stepparent adoption.

Timeline and cost. Stepparent adoptions in Kentucky typically take 3-6 months. Court filing fees generally run $150-$300, and the total typically comes to under $1,000, compared with $3,000-$5,000+ for an attorney.

When to get individual help. If the incarcerated parent contests the adoption, the case becomes more fact-specific. A contested case is a good time to talk with a Kentucky family law attorney. The Circuit Court clerk can answer procedural questions, such as filing steps for your county.
