Yes, you can pursue a stepparent adoption in Alabama when your stepchild's biological parent is in jail, but the steps you follow depend on that parent's situation. The adoption is filed in the Probate Court, and the parent's incarceration affects mainly two things: consent and notice.
Consent or implied consent. An Alabama stepparent adoption petition is filed with consent forms or with grounds for implied consent, plus your spouse's consent to the adoption. If the parent in jail is willing, they can sign a consent. If they are not willing or do not respond, you would look at whether the grounds for implied consent apply. Alabama's abandonment period is 4 months (Ala. Code § 26-10E-9(a)(1), (a)(4)). Whether a parent's time in jail and their contact with your child meet those grounds depends on the facts of your case. Ask an attorney or the Probate Court clerk in your county about that question.
Notice to the parent. Alabama allows personal service, and service by publication if a parent's location is unknown. A parent in jail has a known location, so ask the Probate Court clerk how service should be handled at a correctional facility. If the parent contests the adoption, the case becomes more complicated, and that is a good time to talk with an attorney.
Other Alabama requirements that still apply:
- Residency: Alabama sets no minimum number of months you must have lived in the state (Ala. Code § 26-10E-5(e)(3)).
- Your stepchild's consent: The consent age is 14 (Ala. Code § 26-10E-7(a)(1)).
- Home study: It is not waived in stepparent cases (Ala. Code § 26-10E-26(2)), so plan for it.
- Who can adopt: Any legally married spouse can adopt their partner's child through the stepparent adoption process.
Time and cost. Stepparent adoptions in Alabama typically take 3-6 months. Court filing fees run $200-$350, and the total typically comes to under $1,000, compared with $3,000-$5,000+ when hiring an attorney. Contested cases can take longer and cost more.
