Yes. In Texas, a stepparent can ask the District Court for a stepparent adoption whether the child was born inside or outside of marriage. Under Tex. Fam. Code § 162.001(a), an adult may petition to adopt a child. What shapes your case is the child's current family situation and the legal position of the other biological parent, not whether the parents were married at the birth.
What the court looks at
- The other parent's rights. This is the central question. Texas lets the court address a parent's rights through consent or through grounds such as abandonment under Tex. Fam. Code § 161.001.
- Abandonment. Texas uses a six-month period in § 161.001. Occasional child support does not by itself prevent an abandonment finding, and token contact does not either. Courts look at the whole relationship, including emotional support and involvement.
- Consent without the other parent. If the other parent has not maintained meaningful contact or support, Texas courts routinely approve adoptions without requiring that parent's consent.
- The child's consent. A child who is 12 or older must consent under Tex. Fam. Code § 162.010.
How the birth certificate fits in
Whether the other parent is listed on the birth certificate, was never named, or is unknown can affect how that parent's rights are handled. Those situations depend on the specific facts. For your exact situation, ask the District Court clerk in your county or an attorney. You can also get a copy of the birth certificate from the Texas Vital Statistics Unit so you know exactly what it says before you start.
Texas process basics
- Court: the District Court in your county. Texas has 254 counties, and filing rules and forms can vary a little by county.
- Home study: Texas waives it in stepparent adoptions under Tex. Fam. Code § 107.153(a-1).
- Timeline: a stepparent adoption in Texas typically takes about 3 months.
- Court filing fee: typically $200-$500, depending on the county. The clerk can confirm the exact amount.
- Residency: the clerk can confirm how residency applies to your family and your county.
Common situation
Say your spouse had a child before your marriage and the other parent has never been involved. The key question is still how that parent's rights will be addressed, through consent or through a ground such as abandonment. If that parent is unknown, or if you're unsure whether the other parent has any legal standing, get that specific point confirmed by the clerk or an attorney before you file.
