Yes, a stepfather can adopt his wife's child in Texas. A stepparent adoption is filed in the District Court, and under Tex. Fam. Code § 162.001(a) an adult may petition to adopt a child. Here is what to expect.
Your marriage. You should be married to the child's mother. Texas recognizes common-law marriage if the legal requirements are met. If you aren't sure whether your relationship qualifies, ask the District Court clerk in your county or an attorney.
Residency. Texas sets no minimum residency waiting period for this kind of adoption (Tex. Fam. Code § 162.009).
The biological father. This is usually the biggest question, and it depends on your facts:
- If he agrees, he can consent to the adoption.
- If he has failed to maintain meaningful contact with the child or failed to support the child, Texas courts routinely approve adoptions without requiring his consent.
- Under Tex. Fam. Code § 161.001, abandonment can mean failing to support the child for at least six months, or failing to maintain contact for one year or more.
- Occasional child support payments alone don't prevent an abandonment finding. Courts look at the whole relationship, including emotional support and overall involvement.
- Token contact doesn't prevent an abandonment finding either.
If the father objects, can't be located, or your situation is unusual, talk to an attorney about that specific issue.
The child's consent. Texas sets the child consent age at 12 (Tex. Fam. Code § 162.010). If your child is near or past that age, the child's views and consent are part of the process.
Home study. A home study is waived for stepparent adoptions in Texas (Tex. Fam. Code § 107.153(a-1)), so you generally won't face that step.
Timeline and cost. A stepparent adoption in Texas typically takes about 3 months. Court filing fees range from $200 to $500 depending on the county, and the total typical cost is under $850. Hiring an attorney commonly runs $3,000-$5,000+.
