Are there religious requirements for stepparent adoption in Florida?

No. Religion is not part of the requirements for a stepparent adoption in Florida. The process is a civil court case filed in the Circuit Court under Florida Statutes Chapter 63, and every step in it is legal and procedural, not religious.

What Florida's stepparent adoption process involves:

  • The other parent: A signed consent is one route, but in most stepparent adoptions the other parent never signs one and the judge approves the adoption anyway. In our experience, about 80% of the stepparent adoptions we've completed went forward without the other biological parent's consent. Florida doesn't use a fixed number of months for abandonment; the court looks at the parent's overall conduct, such as contact and support (Fla. Stat. § 63.089).
  • Child's consent: A child who is 12 or older consents, unless the court dispenses with it in the child's best interest (Fla. Stat. § 63.062).
  • Putative Father Registry search: The registry is searched in each adoption proceeding (Fla. Stat. § 63.054).
  • Background checks: FDLE and FBI background checks are part of the process.
  • Home study: Stepparents are exempt (Fla. Stat. § 63.092).

None of these steps asks about your faith, your place of worship, or whether the child has had a religious ceremony.

Where religion can matter to you:

  • Many families add a blessing, a prayer, or a ceremony at their place of worship to celebrate the adoption.
  • Some families hold a faith-based celebration in addition to the court's final hearing.
  • These are entirely your choice and happen alongside the legal process, not as part of it.

Other things to know:

  • Court: Your case is filed in the Circuit Court in your county.
  • Timeline: Many uncontested adoptions finish within a few months; the county court calendar and any publication period set the pace.
  • Cost: Court fees, service or publication, and certified copies are separate and vary by county; the clerk can give you current amounts. Florida allows you to represent yourself in a stepparent adoption.
  • Effect of the adoption: Under Fla. Stat. § 63.172, the adoption ends the legal relationship between the child and the other birth parent, including that parent's duty to pay support going forward, while your spouse remains the child's parent. The child gains inheritance rights through you.

If you don't know where the other parent is: That is common. Florida uses a diligent search followed by service by publication, a routine step that lets the case move forward. If the other parent is actively fighting the adoption, that is the time to talk with a local attorney.
