What documents are used for stepparent adoption in Florida?

Florida's required documents depend on the adoptee's age, parentage and consent or notice route. Start with the current court instructions for your proceeding and county. A document-preparation package and the court's required filing packet are related, but they are not interchangeable promises about every case.

Minor stepparent adoption

The official instructions for Form 12.981(b)(1) describe the joint petition and supporting documents. Depending on the circumstances, these include a parent's consent and waiver or affidavit of nonpaternity, a certified child's birth certificate, the UCCJEA affidavit and putative-father-registry documents. If a required consenting person has died, the instructions call for a certified death certificate.

The child's consent rule should be checked against the current section 63.062: written consent is required for a minor aged 12 or older unless the court dispenses with it in the child's best interest. The dated form instructions do not replace the current statute.

When notice or search is necessary

Use the correct service documents and any required diligent-search affidavit. Publication is conditional; it is not an automatic choice when a parent will not sign. Section 63.088 provides the governing notice and search requirements. Proof of service or authorized publication is filed after the relevant steps occur.

Adult stepparent adoption

Use the separate adult-petition instructions, Form 12.981(c)(1). The adult's consent, a spouse's consent when applicable, and parent-notice documentation are different from the minor packet. Verify local coversheets and hearing instructions.
