The other parent signs or the court decides
If the other parent agrees, we prepare the consent. If not, we prepare the notice, which is a routine step. Wyoming sets no fixed number of months for abandonment, so the court looks at the parent's overall conduct.

Hearing, decree and new birth certificate
Adoption hearings in Wyoming are closed unless the court orders otherwise. After the judge signs the final decree, we help you request the new birth certificate from Wyoming Vital Statistics Services.
Wyoming Vital Statistics ServicesDoes the other parent have to agree?
No. Courts want a two-parent home for your child, and most families we help finish without the other parent's consent. In our experience, about 80% of the stepparent adoptions we have completed went forward without the other parent's consent. We have helped 191 Wyoming families, and we know how to prepare your case either way.
They agree
If the other parent is willing, the consent route is the quickest. We prepare the consent form for your District Court case, and the other parent signs it.
- We draft the consent paperwork
- The other parent signs and returns it
- We add it to your filing packet
They won't sign, or can't be found
If the other parent will not sign or cannot be found, Wyoming law allows the case to go forward on abandonment.
- Wyoming sets no fixed number of months for abandonment.
- The court looks at the parent's overall conduct toward the child.
- You must live in Wyoming for the 60 days immediately before you file.
Notice to the other parent is routine, and we prepare it for you. In Wyoming, termination is not a separate case. It is handled as part of your adoption petition.

Adopting an adult stepchild in Wyoming
Wyoming allows adult adoption, but only if you were a stepparent, grandparent or other blood relative, foster parent or legal guardian who helped raise the adult as a child (Wyo. Stat. § 1-22-102(b)). The adult files a consent with the court, and the adult may live inside or outside Wyoming. You must have lived in Wyoming for the 60 days before filing, and the petition goes to the District Court. If the adult consents, the petition shall be granted, and the statute does not expressly require a hearing (Wyo. Stat. § 1-22-113).
Three steps. That's the whole thing.
Our detailed Wyoming instructions make the process simple, and we are a phone call away at every step.

What Wyoming families ask us
How do I adopt my stepchild in Wyoming?
You file a petition in the District Court of your county, and you must have lived in Wyoming for the 60 days immediately before filing (Wyo. Stat. § 1-22-103). We prepare the petition and every supporting form. Most Wyoming stepparent cases take about 3-6 months.
Can I adopt my adult stepchild in Wyoming?
Yes, if you helped raise them as a child. The adult must file a consent with the court (Wyo. Stat. § 1-22-102(b)). Adult cases often take about 4-8 weeks, and the petition is filed in the District Court.
How much does a stepparent adoption cost in Wyoming?
Our complete package is $349, and each additional child is $99. The clerk of your county District Court sets the filing fee separately. Wyoming waives the home study for stepparent adoptions, so you do not pay for one.
What if the other parent refuses to sign or can't be found in Wyoming?
Your case can still go forward. Wyoming has no fixed number of months for abandonment, and the court looks at the parent's overall conduct (Wyo. Stat. § 1-22-110). In our experience, about 80% of our stepparent adoptions went forward without the other parent's consent. We prepare the notice, and termination is part of the same case.
Does Wyoming require a home study for a stepparent adoption?
No. Wyoming waives the investigation in a stepparent adoption (Wyo. Stat. § 1-22-111(a)(ii)). You do not need to schedule home visits.
Does my child have to agree to the adoption in Wyoming?
If your child is 14 or older, yes. Wyoming requires that child's consent (Wyo. Stat. § 1-22-109). We include the consent form in your packet.
Does the other parent still owe child support after a Wyoming stepparent adoption?
The duty to pay support going forward ends when the adoption is final. Past-due support depends on Wyoming law, so unpaid amounts from before the adoption may still be owed.
Will my stepchild get a new birth certificate in Wyoming?
Yes. After the judge signs the final decree, you request an amended birth certificate from Wyoming Vital Statistics Services. We include that request in your packet.
