Adopting an adult stepchild in Utah
In Utah, one adult may adopt another adult. The adopter must be at least 10 years older than the adoptee, and for a married couple one spouse meeting that gap is enough. The adoptee, each person adopting, the adopter's spouse and any guardian or custodian must consent, but the adoptee's parents do not. The case is filed with the court that has jurisdiction under Title 78A, in the judicial district where the adopter lives. If the adopter is not a Utah resident, it is filed where the adoptee was born or lives. Both of you appear at a hearing, and the court speaks with each of you separately before the decree. Adult cases typically take 4-8 weeks.
