File with the Superior Court clerk
We tell you which county's Superior Court clerk receives your petition and give you a simple filing checklist. Georgia sets no minimum residency months for a stepparent, and the home study is waived.

The other parent signs, or notice is given
If the other parent agrees, we prepare the consent for signature. If not, we prepare the notice papers, which are a routine step. Termination is handled in the same case, not a separate one.
O.C.G.A. § 19-8-10Step four · Hearing dayHearing, decree and new birth certificate
Hearing, decree and new birth certificate
You attend a short Superior Court hearing, and the judge signs the adoption decree. We then prepare your request to the Georgia Department of Public Health Vital Records for your child's new birth certificate.
Georgia Department of Public Health Vital RecordsDoes the other parent have to agree?
No. Courts want a two-parent home for the child, and most families we help finish without the other parent's consent. In our experience, about 80% of the stepparent adoptions we have completed went forward without the other parent's consent.
They agree
When the other parent is willing, a signed consent is the smoothest route in Georgia. We prepare the consent papers so the Superior Court has what it needs.
- We prepare the consent for you
- The other parent signs it
- It goes in with your petition
They won't sign, or can't be found
If the other parent will not sign or cannot be found, Georgia law gives the court a clear ground to move forward.
- Georgia sets a 12-month abandonment period.
- A parent who has abandoned the child for that period can lose parental rights.
- That ground is what allows the adoption to go forward without a signature.
Notice to the other parent is routine, and we prepare it for you. In Georgia, termination is not a separate case; it is part of the same adoption case.
O.C.G.A. § 19-8-10One flat price, and no home study bill
The same decree, the same court, without attorney fees.
What Georgia families tell us
Your service exceeded all of my expectations. We filed our paperwork, had no issues with the court, and finalized our adoption faster than I ever imagined. The support you provided along the way was invaluable. I can’t thank you enough for helping us make our family whole.
Just wanted to let you know that I was completely successful in adopting my Son. Before getting the forms from you an attorney quoted me $5500.00 to do the adoption! When I filed the court clerk seemed very surprised that I was doing it myself without a lawyer, but the process went smooth and without any major hitches. Even when I needed an additional background form, I emailed you and you sent it to me without delay. Thank You. Great customer service
WOW that was fast! THANK YOU! BTW -- my husband adopted my daughter on 8/23/08. The process was smooth and flawless thanks to your detailed adoption packet and instructions. THANK YOU for making our family complete. Wishing you the best.

What Georgia families ask us
How do I adopt my stepchild in Georgia?
You file a petition in the Superior Court, and we prepare all of your documents in 24-48 hours. Georgia sets no minimum residency months for a stepparent, and most families finish in about 3-6 months. The rules come from Official Code of Georgia Title 19, Chapter 8.
Can I adopt my adult stepchild in Georgia?
Yes. Any adult may be adopted if the adult gives written consent, and no relationship, disability or age gap is required. The petition is filed in the Superior Court of the county where any petitioner or the adult lives (O.C.G.A. § 19-8-21(a)).
How much does a stepparent adoption cost in Georgia?
Our complete package is $349, and each additional child is $99. The clerk of your county's Superior Court sets the filing fee, so call the clerk to confirm it. There is no separate home study fee because Georgia waives it for stepparents.
What if the other parent refuses to sign or can't be found in Georgia?
Your adoption can still go forward. In our experience, about 80% of the stepparent adoptions we have completed went forward without the other parent's consent. Georgia sets a 12-month abandonment period (O.C.G.A. § 19-8-10), and we prepare the notice papers, which are routine. Termination is part of the same case.
Does Georgia require a home study for stepparent adoption?
No. Georgia waives the home study for stepparent adoptions (O.C.G.A. § 19-8-16). That saves you time, a home visit and an extra fee. We prepare the paperwork the Superior Court asks for.
Does my child have to agree to the adoption in Georgia?
A child who is 14 or older gives his or her own consent (O.C.G.A. § 19-8-4). We prepare that consent form for you. Younger children do not sign a consent.
Does the other parent still owe child support after a Georgia stepparent adoption?
The duty to pay support going forward ends when the adoption is final. Whether past-due support can still be collected depends on Georgia law.
Will my child get a new birth certificate after adoption in Georgia?
Yes. After the Superior Court signs the decree, a new birth certificate is requested from the Georgia Department of Public Health Vital Records. We prepare that request for you as part of your packet.
