What is the residency requirement for adoption in North Dakota?

North Dakota has no minimum residency period for adoption, so you do not have to live in the state for a set number of months before you file. The rule in N.D.C.C. § 14-15-04 is about where to file, not how long you have lived there.

Where you file (venue). Adoption petitions go to the District Court. North Dakota has 53 counties, and the petition is filed in the right county based on where you live. Under N.D.C.C. § 14-15-04, the petition can be filed where the petitioner or the person being adopted resides, or is in military service, when the petition is filed or when it is granted. For most stepparent families, that means the District Court in the county where your household lives, whether that is Fargo, Bismarck, Grand Forks, Minot, West Fargo or somewhere smaller.

What this means if you recently moved.

  • You do not need to wait out a set number of months before filing.
  • What matters is that you actually live in the county where you file, or that one of the other connections in the venue rule applies.
  • If you are on active military service, the venue rule specifically mentions military service, so ask the clerk how it applies to your posting.

A separate six-month rule for minors. North Dakota also has a six-month live-in rule that applies to adoptions of minors. It is different from a residency requirement for the state, and it concerns the child's time living with the adopting person. The District Court clerk in your county can explain how it applies to your timeline.

Other points that may come up.

  • Child's consent: A child who is 10 or older must consent to the adoption (N.D.C.C. § 14-15-05).
  • Home study: It is waived in stepparent adoptions (N.D.C.C. § 14-15-11).
  • Abandonment: If the other parent's rights are in question because of abandonment, the period in North Dakota is 12 months (N.D.C.C. § 14-15-19). Whether that applies to you depends on your facts, so an attorney or the court clerk can help with that specific question.
  • Timeline: Stepparent adoptions in North Dakota typically take about 3-6 months from filing.

Situations that depend on your facts. If you are splitting time between states, if the other parent is contesting the adoption, or if you cannot locate the other parent, how venue and notice work will depend on the details. The District Court clerk in your county can confirm local filing practice, and an attorney can advise on your particular circumstances.
