What is the residency requirement for adoption in Alabama?

Alabama has no minimum length of residency for a stepparent adoption. You do not have to live in the state for a set number of months before filing (Ala. Code § 26-10E-5(e)(3)). You do need to be a bona fide Alabama resident, and the petition is filed in the Probate Court.

What the residency rule means for you. Alabama requires each petitioner to be an adult (19 or older under Ala. Code § 26-10E-2) and a bona fide Alabama resident, with narrow exceptions under the Interstate Compact (Ala. Code § 26-10E-5(e)). Because there is no waiting period, a recent move does not automatically hold up your filing. What matters is that Alabama is genuinely your home.

What the law doesn't spell out. The Alabama law doesn't say what proof of residency a court wants, or how the court treats an unusual situation such as a military family or a move that just happened. The Probate Court clerk in your county can confirm what they expect to see. If your situation is complicated, an Alabama attorney can advise on that specific issue.

Where you file. Alabama has 67 counties, and adoption cases are handled by the Probate Court. Your county's clerk can tell you which county is the right one for your petition, along with local filing procedures and forms.

Other steps that still apply. Having no residency waiting period doesn't mean the process is instant. Other parts of the case still take time:

• Consent: A child who is 14 or older must consent (Ala. Code § 26-10E-7(a)(1)). Other consents, or grounds for implied consent, are part of the petition package.
• Home study: Alabama does not waive it for stepparent adoptions (Ala. Code § 26-10E-26(2)).
• Abandonment: If the other parent's consent is an issue, Alabama uses a 4-month period (Ala. Code § 26-10E-9(a)(1), (a)(4)). A contested or unknown-parent situation depends on the facts, so talk with the clerk or an attorney about it.
• Timeline: Stepparent adoptions in Alabama typically take about 3-6 months.
