What if the biological parent lives in another state — can I still adopt in Ohio?

Yes. You can pursue a stepparent adoption through an Ohio Probate Court even if the child's other biological parent lives in another state. What changes is mainly how that parent's consent, or the question of abandonment, is handled.

What stays the same:

  • Court: Your petition goes to the Probate Court in one of Ohio's 88 counties. The clerk in your county can confirm exactly where to file.
  • Residency: Ohio has no minimum residency period (ORC § 3107.04), so a recent move to Ohio does not hold you back.
  • Finalization: Ohio requires a brief court appearance to finalize a stepparent adoption.
  • Timeline: Stepparent adoptions in Ohio typically take about 3-6 months.
  • Filing fees: Court filing fees generally run $200-$500, depending on the county.

Consent from the other parent: Ohio's consent rules are in ORC § 3107.06. If the other parent is willing to consent, ask the Probate Court clerk in your county how a parent who lives outside Ohio should sign and return the consent so the court accepts it. If your child is 12 or older, the child's own consent is also required under that section.

If the other parent won't consent or has been absent: Ohio's abandonment provision, ORC § 3107.07, uses a 12-month period. Whether it fits your situation depends on the facts, such as the contact and support during that time. If the other parent may contest the adoption, an Ohio adoption attorney can advise you on your specific case.

If you don't know where the parent is: Ohio has procedures for cases where the biological parent cannot be found. The exact steps depend on your circumstances, so the Probate Court clerk or an attorney can tell you what the court will expect in your case.

Questions to ask the clerk:

  • How the court wants an out-of-state parent's consent signed and returned
  • How the court handles notice to a parent who lives in another state
  • What the court expects if you cannot find the other parent
